The court accepted the government psychiatrist's assessment that the defendant did not suffer Major Neurocognitive Disorder and was fit to stand trial; the renewed fitness application was dismissed because it lacked the statutory minimum of psychiatric evidence required under s75(5) (at least two registered psychiatrists), so the defendant remained fit and the trial proceeded.
