The plaintiffs' application to exclude the admiralty judge from hearing the strike out application failed: an admiralty judge should hear interlocutory matters in the admiralty list where admiralty material is involved, and the existence of without prejudice material does not automatically disqualify the judge from later trying the case; if the action survives, the court may decide whether the admiralty judge should continue to try the case after reviewing the material.
