The appeal was dismissed because the magistrate's finding that PW2 had an unobstructed opportunity to observe and was honest and reliable was open on the evidence; the tourist's absence did not render the amendment unfair because the defence had the tourist's statement and made no application to stay or seek assistance in locating him; the deletion of 'wallet' and notebook shorthand were explainable and did not undermine the prosecution case; accordingly the conviction was properly sustained.
