The court held the Defendant's attempt, by offering settlement on condition that Yau agree not to give a witness statement to the Plaintiff, constituted an unambiguous impropriety and an abuse of the without prejudice occasion; accordingly the without prejudice privilege did not bar admission of the evidence relating to the 26 November 2015 offer and that evidence is admissible at trial.
