A majority concluded that portions of the written handout crossed from lawful explanation of issues into evaluative factual commentary that, given the invitation to the jury to rely on the written text, posed a realistic danger of undue influence on deliberations and thus rendered the conviction unsafe; accordingly the conviction was set aside and a retrial ordered.
