No binding settlement agreement existed because plaintiff's purported acceptance was conditional and not an absolute and unqualified acceptance required by s.7 Contracts Act 1950; consequently the claim based on that alleged settlement was plainly unsustainable, amounted to an abuse of process and was scandalous, frivolous and vexatious; strike out was therefore appropriate and costs were awarded.
