The prosecution failed to prove a prima facie case because it did not establish possession or joint intention against the accused: identification evidence was unreliable (rain, darkness, no positive contemporaneous identification), essential arresting officers were not called, the premises were openly accessible to others and the investigator did not adequately probe alibi or alternate access. Therefore the accused were discharged and freed without being called to enter defence.
