On the balance of probabilities the plaintiff failed to prove minority oppression under s346 Companies Act 2016 on affidavit evidence; material allegations were credibly denied by respondents, many issues required factual trial, and several complaints amounted to alleged corporate loss properly pursued derivatively by the company; therefore the originating summons is dismissed with costs.
