Peraturan 2011 requires that the 'harga jualan' for calculating KWSMP is determined by the sale status and declared prices as at the date of submission of the inspection notice (29.11.2017); payments based on KPKT prices for unsold units at that date are valid for calculation and are not merely provisional; the plaintiff's cause of action accrued only when the defendant produced complete unredacted documentation (02.10.2023), therefore the claim filed in 2024 is not time-barred and plaintiff is entitled to recover the declared shortfall.
