Prosecution failed to discharge its burden to establish a prima facie case under section 403 because key independent evidence (CCTV) was not seized or produced, identification and documentary links to the accused were weak (gatepass only linked invoiced goods to Sarawan), goods were seized from the driver not from the accused, and the investigation was admitted to be incomplete; therefore it was unsafe to call the accused to enter their defence and they were discharged and acquitted at the close of prosecution.

The Court of Appeal held the trial judge erred in acquitting the Respondent at the close of the prosecution case despite finding the act constituting murder proved because medical opinion alone at that stage cannot supplant the requirement to call the accused to enter his defence and prove legal insanity; the defence must be called and the court must evaluate all evidence including defence evidence before determining legal insanity, therefore the acquittal was set aside and the case remitted to the High Court for continuation and for the Respondent to enter his defence.

Prosecution failed to prove a prima facie case because of fatal gaps: nearly five month unexplained delay in sending exhibits to the chemistry, inadequate assurances of exclusive secure storage and potential mixing with other cases, absence of physical identification of seized items by the arresting officer (identification only by photographs), unexplained discrepancies in scene photograph dates and failure to call corroborative witnesses; cumulatively these defects destroyed the chain of evidence and proof of possession, warranting discharge and acquittal at the close of prosecution.
