On the balance of probabilities the court accepted the plaintiff's version supported by dashcam P3, witness testimony and vehicle damage; the defendant's testimony was inconsistent and not credible; the police system printout was excluded for lack of authentication; accordingly the defendant was held negligent and liable and plaintiff entitled to damages for repairs and nominal loss of use plus interest and costs on the court scale.
