The court exercised its discretion under s.138(4) to refuse the plaintiff's application because the need to recall was not caused by unforeseen circumstances, the additional documents could and should have been obtained earlier, there was a history of repeated late filings and prior latitude had been extended, admission would cause prejudice, amount to trial by instalments or a second bite at the cherry, and would undermine Order 34 case management and the just, expeditious and economical disposal of other cases; accordingly the application (Enclosure 97) was dismissed with costs.
