On the balance of probabilities the plaintiffs proved that defendants made false representations which induced the investments, documentary evidence corroborated the representations and the defendants did not hold the offices they purported to hold; the court exercised its discretion under Order 34(2)(3) to disallow the defendants from tendering a defence for failure to comply with court orders while permitting them to cross‑examine, and therefore allowed the plaintiffs' claims with costs.
