The application was dismissed because the First Defendant failed to comply with Order 32 r13(2) by serving the supporting affidavit late, the conduct evidenced deliberate non‑compliance causing prejudice, and the First Defendant failed to establish any bona fide meritorious defence (the pleaded defence was a sham), therefore no proper ground existed to set aside the default judgment.
