The appellate court found the Sessions Court did not act on a wrong principle nor reach a plainly wrong decision: the amendment application by D3 was bona fide, confined to clarifying his own Defence, caused no prejudice (Plaintiffs did not object and any consequential amendments would be limited), and delay did not justify refusal; therefore the Sessions Court's grant of leave to amend was affirmed and the appeal dismissed with costs payable by D1 and D2 to D3.
