Where a claim plainly falls within the monetary jurisdiction of the Sessions Court the High Court may, and should, either transfer the action to the Sessions Court or strike out the writ (with liberty to file afresh) because a litigant has no right to insist on High Court forum in such circumstances and filing in the High Court may constitute an abuse of process.
