The High Court found the trial judge committed insufficient judicial appreciation of the evidence by failing to accept consistent bank records, SSM evidence, unchallenged detailed testimony of strenuous cattle‑related tasks and corroborating medical reports; on the balance of probabilities the appellant carried on a small‑scale cattle business and, as a result of the accident, suffered loss of future earning capacity. The appeal was allowed and quantum awarded accordingly.
