The motion is dismissed because the applicant was informed of the liquidator's admission of the POD on 6.11.2019 but did not apply within the 21‑day period under Rule 93 and has offered no adequate explanation for the almost two‑year delay; s.471 does not permit actions against third parties and s.486(2) only permits court intervention where the liquidator acted fraudulently, in bad faith or so unreasonably that no reasonable person would act so, which was not established; JMB's claim was prima facie supported by invoices and statements.
