The High Court upheld the Sessions Court judge's finding that the prosecution did not establish a prima facie case on the charged incident (10 October 2018) because the child complainant's sworn testimony was inconsistent on material particulars and timing, other witnesses offered only repetition of the complainant's account rather than independent corroboration, and the trial judge properly exercised discretion including drawing an adverse inference for non‑production of a material witness; therefore the order of acquittal and discharge was correctly made and was affirmed on appeal.
