The Court of Appeal allowed the appeal, set aside the High Court decision because the learned Judicial Commissioner erred in disposing final reliefs on affidavit evidence based solely on a prima facie finding of a 'valid dispute' without considering the proviso in paragraph 21(2) SMA and without trial; the originating summons (OS 510) should be converted to a writ under Order 28 r 8 and the affidavits to stand as pleadings for trial before the same judge; costs of RM30,000 awarded to appellant.
