The words 'offensive' and 'annoy' in s 233(1) CMA do not fall within the permissible restriction of Article 10(2)(a) (public order), lack a legitimate aim and rational nexus to the Act's objectives, are disproportionate and operate as a prohibition on protected expression; accordingly those words are unconstitutional and void and are struck down with prospective effect.
