Unexplained contradictions and failure to satisfactorily account for who submitted the complete investigation report produced a material breach of subsection 3(3) which is a procedural precondition to a valid detention under s6(1); that material non‑compliance vitiated the detention process and required judicial intervention, therefore the application for judicial review succeeded.
