The court held that a writ of habeas corpus was available despite the suspension of the operation of the detention order because the detention order remained subsisting; suspension does not negate the detention for purposes of Article 5(2). The detention under Act 316 was unlawful for failing to specify presence of a substantial body as required by Article 149, rendering the detention invalid; the High Court's dismissal was set aside and a writ of habeas corpus ordered.
