The High Court held that s18(4) Sale of Drugs Act 1952 applies to articles purchased or procured for test purposes and does not extend to seizures of unregistered products made under Regulation 26; non-compliance with s18(4) in this context is not fatal, there was no breach of Article 5, and the magistrate did not err in rejecting the preliminary objection; therefore the magistrate's order is upheld and the judicial review application is dismissed.
