The High Court correctly exercised its discretion under s.84 CJA to decline referral because the constitutional challenge to s.265A CPC was a ground(2) inconsistency matter the High Court could decide at first instance and the refusal to refer did not finally dispose of the parties' rights; accordingly the interlocutory appeal was incompetent and was struck out.
