Because the defendant requested additional works after March 2014 and the parties agreed on 13 September 2018 that the balance would be determined by TNB's remeasurement, the sum due was not ascertained until September 2018; therefore the cause of action accrued in September 2018 and the claim filed 14 May 2020 was within the limitation period. The defendant's strike out application therefore failed.
