On balance of probabilities the defendant driver drove into oncoming traffic and zig‑zagged between lanes causing a head‑on collision; defendants are 100% liable and defendant company is vicariously liable; plaintiffs proved dependency, KWSP losses, bereavement and specified special damages with admissible evidence; exemplary damages rejected because not pleaded and statutory/authoritative threshold not met.

Although the defendant owed a duty of care in respect of files on the company-issued laptop, the plaintiff failed to prove on the balance of probabilities that the deleted files rightfully belonged to the company or that deletion caused compensable loss; the Employee Handbook did not expressly establish ownership or a prohibition against deletion; therefore no breach sufficient for damages was established and the Sessions Court decision for the defendant is affirmed; appeal dismissed with costs (nominal damages only if liability assumed).

Applying s.329 NLC and authorities (notably Lim Tee Hin and Lo Foi), the court found the plaintiff proved special losses by documentary evidence and that those losses were a reasonably foreseeable and direct consequence of the wrongful caveat; accordingly the court affirmed special damages of RM114,786.44 and awarded RM50,000 as general damages. The appeal against quantum was dismissed.
