The Federal Court unanimously held that under section 9 of the Government Proceedings Act 1956 the Attorney General has no discretion to grant the written consent after a suit has already been instituted and that consent must be procured by the requisite persons prior to institution; therefore the AG's consent dated 31.5.2016 was invalid and is quashed, rendering OS 1128 incompetent and not maintainable and justifying reinstatement of the High Court's quashing of that consent in the judicial review proceedings.

The Federal Court held that s9(1) and s9(2) of the Government Proceedings Act 1956 require the Attorney General's written consent to be procured prior to institution of any suit claiming the listed reliefs and to be sought by two or more persons; the AG has no power to give retrospective consent after proceedings have been instituted nor to cure the absence of the statutory prerequisites; accordingly the AG's consent dated 31.5.2016 was invalid and is quashed, OS 1128 is incompetent and not maintainable, and the High Court decision quashing the impugned consent is reinstated.

The judicial review was dismissed because the Attorney General lawfully granted consent: he was entitled to make a prima facie determination that the indenture created a charitable trust, that the applicants were interested parties and that an issue existed; the AG was not required to determine merits or consult trustees; the JR was also academic and precluded by the prior OS decision and principles of res judicata/issue estoppel.
