The Court held the appeal to the Chief Minister was not an appeal to the State Authority; therefore the only reviewable decision was the Director's 24 October 2017 refusal. The statutory requirement to give reasons under s66(6) was satisfied by reasons filed in affidavit and the provision does not prescribe timing. The judicial review was brought out of time under Order 53 r3 and mandamus could not be granted because renewal is a discretionary State function with minerals vested in the State Authority. Consequently the application was dismissed with costs.
