The prosecution failed to prove the essential dishonest/forgery and knowledge elements across the charges: evidence did not establish that the accused dishonestly appropriated company funds (s409), did not prove accused forged the 73 cheques (s468) due to inconsistencies and absence of linkage to accused, and did not establish predicate unlawful proceeds or that accused knew or suspected illicit origin for AMLA s4(1)(b). Accordingly no prima facie case existed and the accused was discharged and acquitted at the close of the prosecution case.
