Section 41B of the Dangerous Drugs Act 1952, as construed by binding Federal Court authority, displaces the general bail discretion in the Criminal Procedure Code for offences punishable with more than five years; therefore the Magistrate's refusal to grant bail for an offence under s39B(1)(a) was correct and the High Court will not revise that order.
