The Court held that the matters to be tried were private, familial and sensitive, that existing media publicity created a real and substantial risk of serious prejudice to the trial and that, on balancing open justice against the interest of justice and fair trial, the salutary effects of confidentiality outweighed the deleterious effects; accordingly the protective and sealing orders were necessary and granted under s15(1) CJA and the Court's inherent jurisdiction/Order 92 r4.
