The Federal Court order of 7-10-2013, read with its grounds and subsequent Court of Appeal interpretation, conclusively determined that the transfers of ZZT and ZZH shares were fraudulent and the shareholdings were to be restored to their pre-impugned-transfer positions; therefore P1 has no lawful shareholding and lacks locus standi to bring an oppression claim under s346.
