The BBC was validly terminated on 11.6.2025 for multiple events of default; therefore at the time the writ was issued the plaintiffs had no proprietary or possessory entitlement to the vessel required to invoke admiralty in rem jurisdiction under s20(2)(a) UK SCA 1981. The writ and warrant of arrest were procured without disclosure of that material fact, amounted to mala fides or gross negligence, and must be set aside; possession and control of the vessel are decreed to the registered owner OCM and damages for wrongful arrest are to be assessed and paid by the plaintiffs.
