Section 294(6) KTJ excludes only 'serious offences' as defined by section 52B Penal Code (imprisonment 10 years or more); section 427 Penal Code (punishable 1–5 years or fine or both) is not excluded. Applying the s.294 criteria (first offender, circumstances of the offence, mitigation including early plea, family responsibility, brief remand and public interest) the court properly exercised its discretion to convict and order a bond of good behaviour under s.294 KTJ for two years with RM1,500 security and one surety.
