The trial court correctly found on the balance of probabilities that the plaintiff was not carrying on a moneylending business, the Appellant had admitted indebtedness and made payments corroborated by evidence, and the deduction of RM 207,278.40 was supported by documents; the appellate court will not disturb those factual findings absent clear misdirection, therefore the appeal is dismissed.
