The court found on the balance of probabilities that the Selangor Land Office negligently breached statutory and common law duties by failing to safeguard security paper, by registering a forged Form 19G and by failing to investigate/notify proprietors, which was the effective cause of the plaintiffs’ RM1.5m loss; the court also found that Lee (and his agents) procured the fraudulent removal of caveats with forged documents and that the transfer was obtained by forgery/fraud (and by use of fake title) and is defeasible under s.340 NLC; accordingly the registry’s conduct attracted liability an…
