Prosecution proved beyond reasonable doubt that the 89.8g methamphetamine was a scheduled dangerous drug, that it was in the custody, control and possession of the accused (located in a bag in the accused's car adjacent to him, supported by keys and his attempt to flee) and the statutory presumption of trafficking under s37(da) applied and was not rebutted on the balance of probabilities by the defence; accordingly conviction under s39B(1)(a) and sentence followed.
