The court dismissed the Originating Summons and ex-parte application because the defendant held an Adjudication Decision under CIPAA in its favour which had not been stayed or set aside, rendering the debt undisputable for the purposes of a Fortuna injunction; the plaintiff failed both the 'no chance of success' limb and the 'disputed claim' limb, therefore injunction was inappropriate and dismissal with costs was ordered.
