IO failed to prove on a balance of probabilities that the Adjudication Decision was improperly procured by fraud, there was no denial of natural justice or excess of jurisdiction by the Adjudicator, and the Adjudicator had the power under CIPAA to award interest on adjudication costs; there were no clear and unequivocal errors or justice grounds to warrant a stay, therefore the setting aside and stay applications were dismissed and the enforcement application under s28 CIPAA was allowed (with a correction of a typographical date for interest).
