The court held the plaintiff failed to establish denial of natural justice or apparent bias under s15 CIPAA because the adjudicator considered the plaintiff's defences and made factual findings which are not for court re‑assessment; there was no clear and unequivocal error warranting a stay under s16 and CIPAA's objective of speedy resolution weighed against a stay; accordingly the adjudication decision remained valid and the defendant satisfied the conditions under s28 CIPAA for enforcement, so enforcement was granted with costs.
