On the balance of probabilities the defendant made false or recklessly made representations at seminars and via his appointed marketing agent (Fulda) concerning GT Dollar, Chemopower, Asean Dividend Fund and Fadamas which induced plaintiffs to invest; those representations amounted to deceit and contravened s58 CMSA (unlicensed promotion/dealing in securities).
