The court declared the 1st EOT void because the Housing Controller lacked power under reg 11(3) as established by Ang Ming Lee; it upheld s 35(1) of the COVID-19 Act as lawful and proportionate in context and refused certiorari to quash the 2nd and 3rd EOTs because they were valid exercises of ministerial power, not Wednesbury unreasonable nor breaches of natural justice.
