On the material before the Court (affidavits and exhibits) the plaintiff was an aggrieved person who had completed payment for the auction purchase; the registrar's caveat lacked current supporting evidence (no response from PDRM and no link to any ongoing relevant investigation or to the cited civil proceedings) and the private caveator failed to produce cogent evidence of actual payment or a legally enforceable registrable interest. Therefore both the registrar's caveat and the private caveat were unjustified and had to be cancelled; costs awarded to plaintiff RM2,000.
