On the balance of probabilities the RM20,600 monthly payments were dividends under the investment agreements and not repayments of the friendly loans; the plaintiffs proved primary liability under the Deed of Settlement and the defendants failed to discharge the onus to demonstrate those payments reduced the indebtedness, therefore judgment was entered for the plaintiffs for RM7,100,000 plus interest and costs.
