The court exercised its discretion under s25(2) Courts of Judicature Act and s43 Special Relief Act to appoint receivers/managers to preserve and complete the charged property because the project was partially completed, at risk of deterioration, and completion would protect the interests of the plaintiffs, the defendant and purchasers; the defendant's reliance on s148(2) Sarawak Land Code did not bar equitable interim relief to protect the asset's value.
