The court held that s.41B of the Dangerous Drugs Act 1952 is a specific statutory prohibition on bail for offences punishable with more than five years' imprisonment which overrides the general power under s.388 CPC; the UN Convention is not domestically binding and Child Act s.84 does not apply after charge; accordingly bail cannot be granted and the application must be dismissed.
