The court held it has jurisdiction to hear civil claims predicated on bribery; MACC's 'No Further Action' and the death of a witness do not bar civil proceedings; the doctrine of election does not preclude the Plaintiff's separate fraud claims because the Plaintiff lacked knowledge when it pursued the earlier recovery remedy; issues on Quistclose trust and tracing depend on contested factual inquiries (parties' intention and detailed fund tracing) and are unsuitable for determination under Order 33; accordingly the 2nd Defendant's Order 33 application is dismissed with costs.
