The High Court upheld the Sessions Court's striking out of the endorsement claiming RM300,000 because the validity and enforceability of the sale agreement, the agency/principal relationship and the payment issue had been finally litigated and dismissed in prior High Court proceedings (Guaman 144), rendering the present claim res judicata and 'obviously unsustainable' under O.18 r.19(1)(a),(b) and (d); the appeal was dismissed with costs and the remainder of the suit was remitted to the Sessions Court.
