The mutual termination limited recoverable claims to eligible costs for preliminary works and consultant fees; defendant, having agreed in principle to pay such costs and then failing to analyze or properly challenge the plaintiff's submitted claim as promised, was estopped from disputing the quantum. The court therefore awarded proven sums for works carried out (RM3,571,810.80), allowed a 15% profit on that sum (RM535,771.62) and interest at 5% from judgment until full settlement, with costs fixed subject to taxation.
